End User License Agreement (EULA) for DeeperAI

1. Agreement to Terms

By downloading, installing, or using DeeperAI (“the App”), you agree to be bound by this End User License Agreement (“Agreement”). If you do not agree to these terms, do not use the App.

This Agreement is between you and ironasam43 (“Licensor”), not with Apple Inc. The Licensor is solely responsible for the App and its content.

2. License Grant

Subject to your compliance with this Agreement, the Licensor grants you a limited, non-exclusive, non-transferable, revocable license to:

Install and use the App on any Apple-branded device that you own or control.
Use the App solely for your personal, non-commercial purposes.

3. Restrictions

You may not:

Copy, modify, or distribute the App or any portion thereof.
Reverse engineer, disassemble, or attempt to derive the source code of the App.
Sublicense, sell, rent, lease, or transfer the App to any third party.
Remove or alter any proprietary notices or labels on the App.
Use the App for any unlawful purpose or in violation of any applicable laws.

4. In-App Purchases and Subscriptions

The App offers optional in-app purchases, including:

Premium (monthly subscription): Provides expanded usage and AI token allowance.
Unlimited (one-time purchase): Provides unlimited usage for users with their own Anthropic API key.

All purchases are processed through Apple’s App Store. Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period. You may manage or cancel subscriptions in your App Store account settings.

Prices are subject to change. Refunds are handled in accordance with Apple’s refund policy.

5. AI Features and Third-Party Services

The App uses the Anthropic Claude API to provide AI-powered features. By using these features, you also agree to Anthropic’s usage policies (https://www.anthropic.com/legal/usage-policy).

The App transmits your input text to Anthropic’s servers to generate AI responses.
The Licensor does not store your conversation history on external servers.
AI-generated content may be inaccurate. Do not rely on it for critical decisions.

6. User Data and Privacy

Your use of the App is also governed by our Privacy Policy, available at: https://ironasam43.github.io/ironasam43/deeperai/privacy

7. Intellectual Property

The App and all content, features, and functionality are owned by the Licensor and are protected by applicable intellectual property laws. This Agreement does not grant you any rights to trademarks, service marks, or trade names of the Licensor.

8. Disclaimer of Warranties

THE APP IS PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. THE LICENSOR DOES NOT WARRANT THAT THE APP WILL BE ERROR-FREE OR UNINTERRUPTED.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE LICENSOR SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE APP, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

10. Termination

This Agreement is effective until terminated. Your rights under this Agreement will terminate automatically if you fail to comply with any of its terms. Upon termination, you must cease all use of the App and delete all copies from your devices.

11. Apple-Specific Terms

The following terms apply with respect to Apple Inc.:

This Agreement is between you and the Licensor only, not Apple.
Apple has no obligation to provide maintenance or support for the App.
Apple is not responsible for any claims relating to the App, including product liability claims, legal compliance claims, or consumer protection claims.
Apple is a third-party beneficiary of this Agreement and has the right to enforce it against you.
In the event of any conflict between this Agreement and Apple’s App Store Terms of Service, the App Store Terms of Service shall govern.

12. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of Japan, without regard to its conflict of law provisions.

13. Changes to This Agreement

The Licensor reserves the right to modify this Agreement at any time. Continued use of the App after any changes constitutes your acceptance of the new terms.

1. 規約への同意

DeeperAI（以下「本アプリ」）をダウンロード、インストール、または使用することにより、本エンドユーザーライセンス契約（以下「本契約」）に同意したものとみなします。同意しない場合は、本アプリを使用しないでください。

本契約は、お客様と ironasam43（以下「ライセンサー」）との間で締結されるものであり、Apple Inc. との契約ではありません。ライセンサーは本アプリおよびそのコンテンツに対して単独で責任を負います。

2. ライセンスの付与

本契約の条件に従い、ライセンサーはお客様に対し、以下の限定的・非独占的・譲渡不可・取消可能なライセンスを付与します。

お客様が所有または管理する Apple ブランドのデバイスへの本アプリのインストールおよび使用
個人的・非商業的目的での本アプリの使用

3. 禁止事項

お客様は以下のことを行ってはなりません。

本アプリまたはその一部の複製、改変、または配布
リバースエンジニアリング、逆アセンブル、またはソースコードの解析
第三者へのサブライセンス、販売、賃貸、リース、または譲渡
本アプリに記載された所有権表示や商標の削除・改変
違法な目的または適用法に違反する目的での本アプリの使用

4. アプリ内購入およびサブスクリプション

本アプリは以下のオプションのアプリ内購入を提供しています。

Premium（月額サブスクリプション）：拡張された利用枠と AI トークン上限を提供
Unlimited（買い切り）：独自の Anthropic API キーをお持ちのユーザー向け無制限利用

すべての購入は Apple の App Store を通じて処理されます。サブスクリプションは、現在の期間終了の24時間前までにキャンセルしない限り、自動的に更新されます。サブスクリプションの管理・キャンセルは App Store アカウント設定で行えます。

価格は変更される場合があります。返金は Apple の返金ポリシーに従います。

5. AI 機能およびサードパーティサービス

本アプリは Anthropic Claude API を使用して AI 機能を提供しています。これらの機能を使用することにより、Anthropic の利用ポリシー（https://www.anthropic.com/legal/usage-policy）にも同意したものとみなします。

本アプリはお客様の入力テキストを Anthropic のサーバーに送信し、AI レスポンスを生成します。
ライセンサーは会話履歴を外部サーバーに保存しません。
AI が生成するコンテンツは不正確な場合があります。重要な意思決定の根拠として使用しないでください。

6. ユーザーデータとプライバシー

7. 知的財産権

本アプリおよびそのすべてのコンテンツ、機能、およびファンクションはライセンサーが所有し、適用される知的財産法によって保護されています。本契約は、ライセンサーの商標、サービスマーク、または商号に関するいかなる権利もお客様に付与しません。

8. 保証の免責

本アプリは「現状のまま」提供されるものであり、商品性、特定目的への適合性、および非侵害性を含む、明示または黙示を問わず、いかなる種類の保証も行いません。ライセンサーは本アプリがエラーなく、または中断なく動作することを保証しません。

9. 責任の制限

適用法が許容する最大限の範囲において、ライセンサーは本アプリの使用に起因または関連するいかなる間接的、偶発的、特別、結果的、または懲罰的損害についても、その可能性を知らされていた場合でも、責任を負いません。

10. 終了

本契約はお客様が終了するまで有効です。本契約のいずれかの条件を遵守しない場合、お客様の本契約に基づく権利は自動的に終了します。終了時には、本アプリのすべての使用を停止し、すべてのデバイスから削除してください。

11. Apple に関する条項

Apple Inc. に関して、以下の条項が適用されます。

本契約はお客様とライセンサーのみの間で締結されるものであり、Apple との契約ではありません。
Apple は本アプリのメンテナンスやサポートを提供する義務を負いません。
Apple は製品責任、法的コンプライアンス、消費者保護に関するクレームを含む、本アプリに関するいかなるクレームについても責任を負いません。
Apple は本契約の第三者受益者であり、お客様に対して本契約を執行する権利を有します。
本契約と Apple の App Store 利用規約との間に矛盾がある場合、App Store 利用規約が優先されます。

12. 準拠法

本契約は、抵触法の規定にかかわらず、日本国の法律に従って解釈されます。

13. 本契約の変更

ライセンサーはいつでも本契約を変更する権利を留保します。変更後も本アプリを継続して使用することは、新しい条件への同意を意味します。
